Terms of Service

These terms govern your use of GoneAshore, a digital IN / OUT gangway board for superyacht crew, provided by Flavio Baldi ("we", "us"). By using the app you accept them.

1. What the service is

GoneAshore lets each crew member mark whether they are aboard or ashore, shows the bridge a live tally, derives who is on duty from the roster, carries a crew notice board, and supports a muster roll call when an alarm is raised.

The service is licensed per vessel, with a seat limit set by the plan. A vessel may add crew up to that limit. The account of each crew member is bound to their device and is personal: accounts are not shared.

2. Safety — the important part

GoneAshore is an aid to awareness. It is not:

The information the app shows is only as accurate as what the crew put into it. A person who steps ashore without updating their status will appear aboard. Network coverage at sea is imperfect and notifications can be delayed or lost.

In an emergency, follow the vessel's procedures and count heads. Do not rely on GoneAshore as the sole determination of who is aboard. The Master remains responsible for the safety of the vessel and everyone on it.

3. Accounts and permissions

The Captain is the administrator of the vessel's account and assigns permissions to specific individuals. You are responsible for the accuracy of what you post and for keeping your credentials secure. Tell us promptly if you believe an account has been compromised.

You agree not to use the service unlawfully, not to attempt to access another vessel's data, and not to post content that is unlawful, harassing or that misrepresents a safety-critical fact.

4. Records and archiving

Departed crew are archived rather than deleted, so that historical board and muster records stay intact. See the Privacy Policy for what this means for your personal data.

5. Plans, trial and payment

A free tier is available with a limited number of seats. Paid plans are tiered by seat count and are billed monthly or annually. New vessels may start with a free trial of 30 days.

Where a subscription is purchased through the Apple App Store or Google Play, the purchase, renewal, price and refunds are governed by that store's terms, and it is the store that charges you. Subscriptions renew automatically unless cancelled through the store before the end of the current period. Prices are shown in your store's local currency.

Where a subscription is purchased directly from us, the applicable terms and the price are those stated at the time of purchase.

If a vessel's plan lapses or its crew count exceeds the seat limit, the service may be restricted until the plan is brought back into line. We will not delete a vessel's records because a payment lapsed.

6. Availability

We work to keep the service available, but we do not guarantee uninterrupted or error-free operation. The service depends on internet connectivity, on third-party infrastructure, and at sea on satellite links that are outside our control. We may change, suspend or discontinue features, and will give reasonable notice of material changes where we can.

7. Intellectual property

The app, the website, their design and their content belong to us. Data you and your vessel enter remains yours. You grant us only the permission needed to store and display it in order to run the service.

8. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, and to the maximum extent permitted by law, the service is provided "as is"; we exclude implied warranties; and we are not liable for indirect or consequential loss, loss of profit, or loss arising from reliance on the app's information in place of the vessel's own procedures. Our total liability in any twelve-month period is limited to the amount paid for the service in that period.

If you are a consumer, your statutory rights are not affected.

9. Termination

A vessel may stop using the service at any time. We may suspend or terminate access if these terms are seriously or repeatedly breached, or if required by law, and will give notice where we reasonably can.

10. Governing law

These terms are governed by the law of Poland, and the courts of Poland have jurisdiction over any dispute arising out of or in connection with them. If you are a consumer, this does not deprive you of the protection of the mandatory provisions of the law of your country of residence.

11. Changes

We may update these terms. The date at the top shows the current version, and material changes will be announced in the app before they take effect.
